BRAZIL: Lula Defense Team Files Appeal To Higher Courts

(RTTNews) - The defense team of former President Luiz Inacio Lula da Silva last night filed a special appealing to Brazil's Higher Court of Justice (STJ) and in the Federal Supreme Court (STF) contesting the 12 years and a month jail sentence on corruption and money laundering charges.

The extraordinary appealing contests previous rulings that increased or kept Lula's conviction during the lawsuit, including the last possible appeal at the second instance last week.

According to the lawyers Cristiano Zanin and Valeska Teixeira Zanin, the previous rulings contradict several provisions of the Brazilian legislation.

"These articles refer, among other things, to the impossibility of being judged by a biased magistrate, the impossibility of prosecutors acting as real enemies of the defendant, the need for forensic evidence related to crimes that 'leave traces,' the inability of the judge who refused to examine new documents that confirm the innocence of the defendant," the defense said.

The special appealings' admissibility should be judged by the 4th Regional Federal Court, that same that convicted Lula. The defense team considers that the criminal lawsuit should be ruled null and void. Lula was arrested earlier this month.
